
In a major development, High court of Jammu & Kashmir has asked separatists to shun their ideology or stay incarcerated. According to Ahmed Ali Fayyaz of Daily excelsior, MA Qayoom who had approached the court to end his detention, has been given the aforementioned decision by Justice AM Magrey & Justice VC Koul.
Mian Abdul Qayoom, is a well known lawyer and who till very recently held the position of Kashmir Bar president. He was detained last year as a precautionary measure in the wake of constitutional changes made by the government. In the past he’s known to have represented many separatist leaders who were booked by the Police. Earlier in 2017, he was also summoned by the NIA (national investigation agency) in terror funding case.
Apparently, Mian Qyoom had challenged Writ court order dismissing his habeas corpus petition, and prayed for quashing of his detention under PSA. The bench found Qayoom to be holding “separatist ideology” which was “pertinent and proximate”, ergo it could instigate youth in Kashmir. The ideology which has not gone stale and is not time bound, can indeed be perilous in the long run.
Separatist ideology believes, in giving Kashmir as separate nation status, but it has so far been an excruciating ideology which has jeopardized India’s sovereignty. So far, Indian governments and courts have dealt separatism with kid gloves, whilst the separatist leaders went on to sabotage peace in the valley. Will this be an end of separatist ideology? Possible! This decision by the court is a welcome change.
